1 General information and scope

The following general terms and conditions apply between I V me GmbH (contractor), with its registered office at Habsburgergasse 5/5a 1010 Vienna, and the customer/patient (client) for all services/treatments provided at the registered office. The version of the general terms and conditions applicable at the time the contract is concluded shall be the definitive version.

The contractor and its employees perform their services to the best of their knowledge and belief and to the latest standard. All employees have medical training (practice assistant, qualified nurse, doctor).

2 Obligations of the customer/patient

The customer/patient is obliged to inform the contractor and thus your entire medical team truthfully about existing medical conditions before the start of treatment. 

3 Contract conclusion

The offers are subject to change. The right to make alterations within the realms of reasonableness is retained.

  • By making an appointment for a service, the customer/patient declares acceptance of the contract offer.
  • If the contract is concluded electronically, the receipt of the booking request will be confirmed to the customer/patient in writing or by telephone.
  • The provision of access does not yet constitute binding acceptance of the booking.

Binding acceptance of the booking is made upon written or telephone confirmation of the appointment.


4 Prices and terms of payment

  • All prices for the execution of the services/treatments are based on the current price lists, which are available for inspection at the place of business or are available on the Internet.
  • New price lists automatically replace all previous ones and apply from their announcement in the store or on the Internet.
  • All services are subject to medical activities and are therefore exempt from VAT.
  • The prices are due for payment immediately after completion of the treatment and without discount at the place of business in cash or by card.
  • Payments by direct debit or on account are not accepted.


5 Amendments and reservations

  • When new offer and price lists appear, all previous ones lose their validity.


Retention of ownership

The contractor reserves the proprietary rights to the goods (goods of sale) until the full payment of all claims under any current business relationship.

7 Treatments not carried out/treatment times/treatment duration

Treatment appointments, including those agreed by telephone, are considered binding from receipt of the appointment confirmation.

Changes to dates are possible no later than 24 hours (on working days) before the agreed date.  

If the customer/patient cannot or does not want to attend an agreed appointment and this was not postponed or cancelled in time, the following applies, unless otherwise agreed:

  • For treatments already paid for (e.g., vouchers or subscriptions), there is no entitlement to a refund or partial refund of the price paid.
  • In the case of unpaid treatments, the obligation to pay the agreed treatment price, but at least a cancellation fee of 50% of the price, remains.


8 Treatment exclusion

The contractor reserves the right to refuse implementation of treatments if there are health or hygienic reasons to the contrary. This will be decided by our team of doctors and medical team.

The customer/patient undertakes to behave appropriately during the visit. If the customer/patient continues to behave inappropriately even after a warning, the contractor has the right to expel the customer and, if necessary, to issue a premises ban.

9 Promotions/vouchers

  • Ongoing special promotions do not have to be designated as such by the company.
  • Offer campaigns are only valid during the advertised period and are to be taken advantage of during this period or apply as long as items are in stock.
  • Gift vouchers are valid indefinitely.
  • Vouchers and subscriptions are fully transferable. Upon their redemption, they pass back to the possession of the client. In the case of lost or stolen vouchers and subscriptions, no compensation will be paid – even if the receipt is presented. Vouchers that have not been fully paid for, have been damaged or have been falsified can be rejected.
  • Discounts, rebates, special prices and other reductions cannot be combined. Promotional vouchers are always credited towards the list price and can only be redeemed once per person.


10 Data protection

The customer/patient expressly agrees to the collection, processing and use of his personal data. This is recorded in writing in our administration system by means of GDPR consent. As a medical company, we are subject to strict confidentiality and documentation obligations. If necessary, a transfer is also made to the companies involved in the business transaction. Beyond this, data will not be passed on to third parties.

The customer/patient can revoke their consent to the storage and purposeful processing of their data at any time in writing or by sending an e-mail.

11 Disclaimers

If the customer/patient fails to inform the contractor before the start of treatment about existing medical conditions or allergies that prevent treatment, the latter assumes no liability for possible consequential damage.

The contractor assumes no liability for cloakroom items and valuables that are carried by the customer/patient or have been left behind in the company.

12 Ancillary provisions

The law of the Republic of Austria applies exclusively to the contract concluded with the contractor and these terms and conditions.

Deviating or supplementary provisions to this contract, such as ancillary agreements, are only binding if they have been confirmed in writing by the contractor.

13 Severability clause

Should individual provisions of the contract with the client, including these general terms and conditions, be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions.

The entire or partially invalid provision shall then be replaced by a provision whose economic purpose comes as close as possible to that of the invalid provision.
